Description | CONDITIONS for Agreement between (Lord Cholmondeley) and Mr. Drake, whereby the said Lord Cholmondeley is willing to allow Mr. Drake the tolls of MALPAS FAIR, reserving 1/8 of the tolls called Pitching Pennys, and with the proviso that Mr. Drake undertakes the collection thereof and the expence of the Fair Dinner; he concedes Drake's right of walking and proclaiming Fairs and the right to swear Constables etc: in his Court; he allows him the royalty of towns, cottages, rents etc: in AGDEN, BADELEY, CALDECOT [Caldecott], CARDEN, CASTLETOWNE [Castletown], DUCKINGTON, NEWTON, STOCKTON, STRETTON, SHOCKLATCH [Shocklach], but reserves the right to cottage rents in EDGE, MALPAS and TILSTONE [Tilston], a quarter of the rents of any new cottage erected there, suit of court and a quarter of the waifs, strays etc: he insists on the royalty of BARTON and all cottage rents etc: there, but allows that tenants owe suit of court to Mr. Drake's Courts; he postpones the settlement of the dispute about the moor part of William Overton's tenements.
