DescriptionLEASE for 1 year & RELEASE between:-

1) Rt. Hon. Henrietta Cavendish Holles, Countess Dowager of Oxford and Counteds Dowager Mortimer, the Most Noble Prince William Duke of Portland and Margarett Cavendish Duchess of Portland his wife,

2) the Rt. Hon. George Earl of Cholmondeley, Chancellor of the Duchy and County Palatine of Lancaster, and Charles Legh of Adlington,

3) Sir Roger Bradshaigh of Haigh (Co. Lancs),

4) Sir John Bridgman of Castle Bromwich (Co. Warwick) Bt.,

5) Hon. James Cholmondeley of Rock Savage esq., and Lady Penelope his wife;

after reciting various deeds etc: and that the said James Cholmondeley has paid the costs taxed to the parties in the above suit (except the costs taxed to Lord Pitt and Lord Stawell, her trustee), now the said Henrietta Cavendish Holles, Countess Dowager of Oxford and Countess Dowager of Mortimer, and William Duke of Portland and Margarett Cavendish Duchess of Portland his wife, release to the 2nd party the premises in the County of Chester mentioned in the Act of Parliament (no. DCH/E/355) to be vested in Robert late Earl of Oxford and Earl Mortimer, his heirs and assigns, which now remain undisposed of and have not been sold in execution of the trusts therein mentioned (except parcels of land in FRODSHAM and a warehouse erected thereon), subject to annuities of £50 a piece to Catherine Kesson and Katherine Fitzer, the estate for life of Richard Surridge in HUXLEY FARM and the mortgage of £5,000 and interest whereunto the said Lora Pitt is entitled; to the use of Sir Roger Bradshaigh for the residue of the term of 200 years limited in the settlement of 19. July, 1729, on trust during the lives of James Earl of Barrymore and Lady Penelope Cholmondeley, to raise the yearly rent of £400 for the separate maintenance of the said Lady Penelope, the residue of the rents to be received by James Cholmondeley for life, and after his decease by the parson/s to whom the reversion or remainder of the premises expectant on the determination of the term of 200 years shall belong; and after the decease of either the said James Earl of Barrymore or Lady Penelope Cholmondeley, and the discharge the arrears of the said sum of £400, the said Sir Roger Bradshaigh shall surrender the residue of the term to the person in remainder expectant on the said term on the trusts appointed.
