Description | ARTICLES OF AGREEMENT between:-
1) Tobias Bretland of Thorncliff, esq., and Richard Ireland of London, merchant,
2) Hon. James Cholmondeley of Rocksavage, esq.
recites that whereas in 1705 a chancery suit was brought by Rt. Hon. Richard late Earl Rivers deceased against George Bretland esq., nephew and administrator of Reginald Bretland esq., Serjeant at law deceased, for an account of the rents and profits of part of the estate of Thomas Earl Rivers in the COUNTY OF ESSEX (conveyed to the said Bretland and others in 1678, in trust for the payment of his debts), and for satisfaction out of the real or personal assets of the said Reginald Bretland for the moneys received, and reciting (inter alia) a Master's Report of 14. Feb., 1717/18, that there was £13,596-5-7 due to the trustees of the said Earl Rivers and that the said George Bretland did not pay the same, but consented to let the plaintiff into possession of part of the estates of the said Reginald Bretland in the Counties of DERBY and LANCS., from which the rents have since been received, that the debts and costs owing from Serjeant Bretland's estate were subsequently assigned to James Cholmondeley, that the said James Cholmondeley has agreed to accept £10,000 in lieu of the sum of £13,596-5-7, and that the said Richard Ireland has at the instance of Tobias Bretland paid £2,000 to the said James Cholmondeley, now the said Tobias covenants to pay £8,000, the remainder of the said sum of £10,000, and the said James Cholmondeley covenants, on receipt of the said sum, to assign his title to the said sum of £13,596-5-7 and to quit possession of the estate of the said Reginald Bretland.
