DescriptionCOVENANT TO LEVY A FINE between:-

1) Hon. Sir Thomas Savage of Rocksavage Kt. and Bt., and Lady Elizabeth his wife,

2) Rt. Hon. Elizabeth Lady Morley, widow, late wife of William Lord Morley and Mounteagle, deceased, and Henry now Lord Morley and Mounteagle,

3) Sir John Savage Kt., eldest son and heir of the said Sir Thomas Savage and Dame Katherine, wife of the said Sir John,

4) Rt. Hon. Francis Earl of Rutland, William Noy of Lincolns Inn Esq., John Minshall of Minshall esq., and William Alcocke, gentleman,

whereby the 1st party agrees to levy a fine to the 4th party on Manors of ROCKSAVAGE [Rock Savage] alias CLIFTON, HELLESBY [Helsby], BARROWE [Barrow], TARVIN and HUXLEY, 1/3 of the Manor of OVER RANCKHORNE [Over Runcorn], 2 closes or woody grounds in CATTENHALL called Cattenhall Woods, demesne lands of BRADLEY ORCHARD called Pykes and Williamsons Fermes in BRADLEY in the lordship of FRODESILAM, with all other messuages etc: in ROCKSAVAGE, CLIFTON, NETHERTON, OVERTON, WOODHOWSES [Woodhouses], BRADLEY, OVER RONCKHORNE, NETHER RONCKHORNE [Nether Runcorn], HALTON, HALTON PARKE [Halton Park], HELLESBIE, GREAT BARROWE [Great Barrow], LITLE BARROWE [Little Barrow], BROOMEHILL [Broomhill], TARVIN, HUXLEY, CATTENHALL WOODS, MACCLESFEILD PARKE [Macclesfield Park] and MACCLESFEILD [Macclesfield], being premises contained in a covenant to levy a fine made between the same parties, 18. June, 1625, and the Manors of SHIPBROOKE [Shipbrook], BOSTOCKE [Bostock], LEFTWYCH [Leftwich] and KINGESLEY [Kingsley], and all other messuages, lands etc: there and in SHURLACH, DAVENHAM, WARTON, MOULTON, OCCLESTON [Occlestone], NORCROFT, NEWTON, NORLEY, CROTON [Crowton], CUDDINGTON, WYCHMALBANKE [Wich Malbank], HENHULL, POOLE, ALDLEM, WRENBURY, HALE, MOTTRAM ANDREWE [Mottram St. Andrew], OLLERBARROWE, LYM [Lymm], WOLSTENCROFT, STOCKPORT, CHORLETON, ORTON, TILSTON, THELWALL, GRAPENHALL [Grappenhall], APPLETON, KNOTESFORD [Knutsford], ASHLEY, SUTTON neare MACCLESFEILD [Sutton near Macclesfield], RAYNOWE [Rainow], HURDSFEILD [Hurdsfield], DISLEY, ANGREVE, MIDGESLEY and WINCLE, 1/6 of the Barony of WYCHMALBANKE alias NAMPTWYCH [Nantwich], the agistment of 80 beasts, called fowerscore beast gates, in a pasture called the Backsyde of Wyldboreclough, and all the messuages, lands etc: of the said Sir Thomas Savage in the city of Chester, to the following uses:- the Manors, messuages etc: comprised in the Indenture of 18th June, except the Manors of BARROWE and TARVIN and other premises there and in MACCLESFEILD and MACCLESFEILD PARKE, to the uses declared in the said Indenture the said Manors of BARROWE and TARVIN and other premises there and in MACCLESFEILD and MACCLESFEILD PARKE, to the use of Sir Thomas Savage and his assigns for life, remainder to the 4th party in trust, if the said Sir John Savage causes payment of £1,500 as marriage portions for each of the daughters of the said Sir Thomas, to convey the Manors etc: to such persons for such estates as are limited by the said Indenture, or otherwise sell parts of the said premises to raise the said portions, the remainder of the premises to be conveyed on the trusts declared in the said Indenture; the residue of the premises, of which the trusts are not declared, to be to the use of the said Sir Thomas for life, and after his death such parts are to be sold or otherwise disposed of as necessary for the payment of his debts, the remainder to be conveyed to the heirs of the said Sir Thomas.
