Description | AWARD (contemp. copy) of King Henry VIII in a dispute between 1) Sir Peers Dutton Kt., cousin and heir male to Lawrence Dutton esq. and 2) Sir William Mollenex and Sir Thomas Surthworth Kts., Thomas Aston and Richard Cholmondley esq., 4 of the 5 cousins, co-partners and next heirs general to Sir Hughe Dutton Kt. and Dame Jane his wife; whereby the said Sir Peers and his heirs male are to have the Manor of DUTTON, with messuages, lands etc: in DUTTON and ASTON, the advowson of the chapel of (Powersey), the lordships, manors, lands etc: of WESTON, PRESTON, BARTERTON [Bartington], LEIGHE [Leigh], NESSE [Ness] IN WIRRALL [Wirral], LITLE MOULDSWORTH, ACTON, and HAPPESFORD, and all the lands, tenements etc: of Sir Peers Dutton Kt., son of Edmond Dutton, John Dutton esq., and Sir Thomas Dutton Kt., or any other person to their use, in WESTON, CLEFTON [Clifton], PRESTON, BARTERTON, LEIGHE, NEESSE IN WIRRALL, LITTLE MOULDSWORTH, ACTON, HAPPESFORD [Hapsford], STONYE DUNHAME [Stoney Dunham], MICLE BARROWE [Mickle Barrow], STOKE, PICKTON, ARROW, NORTHWICH, HALTON, THELWALL, ONSTON, MIDLEWICH [Middlewich], STANTHORNE and OVER RONNAKHERNE, with appurtenances, (except certain lands and tenements in LEIGHE lately purchased of one John Moolley (sic) and certain lands in NORTHWICH lately purchased of one Roger Starkye and such lands in HALTON as are held by copyhold and not entailed), remainder in default of heirs male, to the right heirs of Sir Thomas Dutton Kt., son of the said John Dutton. The said Sir William Mollinex and Sir Thomas Southworth Kts., Thomas Aston and Richard Cholmondley esqs. shall and enjoy severally, as co-partners in that estate, ¼ of the lordships and manors of CHURCH MINSHULL, ASTON in MONDREN and KEEKWICKE [Keckwick] and all the lands etc: which were the the lordships etc: of the said Sir Peers Dutton Kt., son of the said Edmonde Dutton, John Dutton and Sir Thomas Dutton Kt. or any other person to their use, in CHURCH MINSHULL, ASTON in MONDREN, KEEKWICKE, KINGSLEY, NORLEY, CHORTON, DODDINGTON, POULTON LAWNCELLAME, BRADLEY, BUDWORTH in FRITHE [Frith], MYLNETON [Milton], BARNTON, OVER WHITLEY, ASTON neere BUDWORTH, HELSBYE [Helsby], FRODSHAME [Frodsham] and in the city of CHESTER, and all the lands, tenements etc: in NORTHWICH purchased of one Roger Starkye, and the copyhold lands in HALTON which are not entailed. It is further awarded that whereas John Savage esq., the 1st of the 5 co-partners, is not of the age of 21 years and therefore not party to the bond of submission preceding the Award, the said Sir Peers Dutton and his heirs male, the said John Savage and the heirs of Elizabeth, late wife of Raphe Bost(ock), shall be at liberty to stand to the Award or refuse the same; and it is awarded that if the said Sir Peers Dutton die without heirs male, it shall be lawful to the right heirs of Sir Thomas Dutton Kt., son of the said John Dutton, to enter into the premises appointed to the said Sir Peers, and if the said Sir William Mollinex, Sir Thomas Southworth, Thomas Aston or Richard Cholmondley die without heirs male, then it shall lawful to the next heir/s of the said Sir Thomas Dutton Kt., son of the said John, to enter into the share of him or them so dying.
