DescriptionACT for settling the estates of Richard late Earl Rivers, deceased, pursuant to an Agreement between Frederick Earl of Rochford, and Bessy, Countess of Rochford, his wife; James Barry, Earl of Barrymore, in the kingdom of Ireland, and Lady Penelope Barry, his daughter; and John, now Earl Rivers, subject to the payment of the debts and legacies of the said late Earl Rivers, remaining unpaid, and for other purposes in the said Act mentioned. (Lancashire Estate) Manors of WORSLEY, PEMBERTON and BARTON, a capital messuage called Worsley Hall, and messuages, lands etc: in WORSLEY, PEMBERTON, BARTON, WIGAN, and SWINTON MOORE, to the use of James Barry for life, remainder to the use of Lady Penelope Barry and her heirs, and in default to the uses appointed in the Settlement of 27. Feb. 1684/5.(Yorkshire Estate) Manor of BRIGNALL and messuages, lands etc: there, to the use of James Barry for life, remainder to Lady Penelope Barry and her heirs, and in default to the use of the persons capable at the time of the failure of such issue to take lands by descent as right heir of the said Richard.(Cheshire Estate) Manors of ROCK SAVAGE alias CLIFTON, FRODSHAM, KINGSLEY, MOORE, RUNCORNE [Runcorn], BARROW, TARVIN, HENHULL, AULEM alias AUDLEM, MARBURY, WEAVERHAM alias WEEVERHAM, GROPPENHALL alias GROPNALL [Grappenhall]. 1/6 of the Manor and Barony of NANTWICH, ¼ of the Fee of KINGSLEY, the capital messuages of Mansion Houses called Rock Savage Hall in ROCK SAVAGE, and MARBURY HALL in MARBURY, and the Park called Rock Savage Park alias Clifton Park, with messuages lands etc: in ROCK SAVAGE alias CLIFTON, RUNCORN, HALTON, FRODSHAM, OVERTON, NETHERTON WOODHOUSES, BRADLEY, HELSBY, KINGSLEY, NEWTON, NORLEY, CUDDINGTON, TARVIN, OSCROFT, GREAT BARROW, LITTLE BARROW, BROOMHALL, NORTHWYCH [Northwich], MACCLESFIELD, MACCLESFIELD PARK, HURDSFIELD, SUTTON, HENHULL, NAMPTWYCH [Nantwich], AUDLEM, MARBURY, CATTERISH alias REDDISH, GROPPENHALL, COGGSHALL [Cogshall], COMBERBACH, HATTON, PICKIMERE, ANDERTON, BARNTON, WIMMICHAM alias WINCHAM, OVER CODLEY, LATCHFORD, THELLWALL, LITTLE LEICH [Little Leigh], ASTON, iuxta BUDWORTH [Aston by Budworth], OVER WHITTLE, BRYNN, WEVERHAM, GORSTICH and SANDIWAY (except the said Manors of MARBURY, WEAVERHAM, GROPPENHALL and LATCHFORD, the Barony of SHIPBROOK, the advowson of DOVENHAM, a fee farm rent in MOSTYN and the reversion of a small burgage in NORTHWICH, sold by Charles late Duke of Shrewsbury and Robert Earl of Oxford and Earl Mortimer, in pursuance of the Trust reposed in them, to James Earl of Barrymore), in trust to the said Earl of Oxford to pay off the sums of money and incumbrances specified, by the sale, mortgage or lease of such parts of the said premises as shall be necessary; the remainder unsold, in trust for James Barry Earl Barrymore for the life of John Earl Rivers, remainder to Penelope Barry and her heirs, remainder to such person as shall be capable at the time of the failure of such issue to take lands by descent as right heir of the said Richard Earl Rivers.(Essex Estate) Manors of CHICH 6 HYGH ST. OSYTH, WYVERHALL, WICKBOROW in CHYCH, GREAT CLACKTON, LITTLE CLACKTON, KIRBY, THORPE, WALTON and EARSHALL, 1/6 of the Manor of CANHALL, Manor or Mansion House, and site of the late dissolved Monastery of ST. OSYTH, rectories of CHICH CHICH, ST. OSYTH, GREAT CLACKTON and LITTLE CLACKTON, KIRKBY, THORPE, WALTON and LITTLE HOLLAND, with messuages, lands etc; there, to the use of Bessy Countess of Rochford and her assigns for life, remainder to the use of the 1st son and his heirs male, then to successive sons and their heirs male, remainder in default to every daughter/s as tenants in common and their heirs, remainder to Lady Penelope Barry and her heirs, remainder to such parson as shall be capable at the time of the failure of such issue to take lands by descent as right heir of the said Richard Earl Rivers. 7 George I.
