DescriptionRex, v. George Johnson and others. a 1734. Copy of judgment upon the challenge. '1st Session at Chester'. 3ff. b 15th Jan., 1733/4. Letter from Robert Andrews to ?E. Partington. Concerning making a copy of the charter of 1506. He will try to get Mr. Williams and Sir Robert Grosvenor to have a consultation about whether to show cause or not. Other affidavits for the case. He hopes Mr. Recorder is now preparing a proper state of the case on the points now necessary to be considered. Endorsed 'abt. the Inform' in the K.B. agt. the Aldm. & c of Chester'. c 19th Jan., 1733/4. Draft of letter from E. Partington to Robert Andrews in answer to b; from Chester. Sends the affidavits of Alderman Johnson and others, and discusses affidavits about the method of election. d 1734 i. Letter from Ro. Andrews to E. Partington from Grosvenor House. Instructs him concerning resignations of their freedom to be made by the gentlemen mentioned in the enclosed list. If there are any other gentlemen who are freeholders who are 'in the book', they must be applied to to do the like. ii. Draft reply from E. Partington to Ro. Andrews from Eaton. He has procured a good many resignations, and when the Mayor returns from Nottingham, they will have an Assembly to accept the resignations. The Recorder will give him in writing what instances there are of the Corporation not acting in accordance with the charter of 16 Chas. II. The Recorder is busy about the informations against Sir Robert Grosvenor, the Mayor and the Aldermen. iii. Letter from Andrews to Partington. The had a consultation last night and the pleas were fully drawn on the charter of 37 Chas. II; but, after debate, it was resolved to lay them aside and plead the charter of Henry VII as to the Mayor, and the usage as to the rest. But someone must point out all the instances where the Corporation does not act in accordance with the charter of 16 Chas. II, as they are obliged to traverse the acceptance of that charter. iv. Draft as in ii. The Mayor has not yet returned. Concerning payment of bills drawn on Andrews. Endorsed 'King agt. Grosvenor'. 2 ff. e April, 1734. Letter from E. Partington to R.Andrews concerning his procuring copies of the legal proceedings and other legal matters. Together with; copies of the plea, demurrer and rejoinder in Rex v. Johnson et al. f 22nd April 1735. Letter from Robert Andrews to E. Partington. He has received from him the draft of the postea and copies of the challenge, plea and demurrer; and, when the copies of the jury process arrive, he will lay them before Mr.E.Bootle to settle the postea. 1 f. g 6th May 1735. Letter from the same to same, from London Mr. Bootle has settled the draft of the postea, but he thinks that a great part of that draft and all the proceedings at the Assizes are already entered upon the roll, and therefore cannot be altered. Desires him to apply to the Frothonotary for a sight of the record. h 10th May 1735. Draft letter from E.Partington to Robert Andrews. He has been with the Prothonotary and finds that all the proceedings from the first Assizes of 13th April, 7 George to the second on 25th August last, are already entered on the roll. 1 f. i n.d. Draft of another, or part of the same letter, written on paper directed to 'Mr.Partington, at his house in Watergate Street, Chester'. Concerning a case about the printing of news on paper not stamped. Encloses a rule of the King's Bench, and desires him to move for time. 1 f. j 1733-34 The King v. Peter Ellames as Mayor. Copy of the information. 1 f. k 13th March 1732/3/ 'Proofs submitted as proper to be made on behalf of the persons complained against in the petition annexed'. Case and opinion by J.Darnall concerning dispute over parliamentary election in which Sir Robert Grosvenor was victorious over Mr. Wanley, and question whether non-resident freemen were entitled to vote. Refer to riots before at the Mayor's election, which took place before the parliamentary election. 2ff. l 22nd March 1732/3. 'An addition to the Case laid before Serjt. Darnall'. Further questions, 1f. m 1733 ? Statement on behalf of Sir Robert Grosvenor, the sitting member, that the right of election at parliamentary elections in Chester is in the freemen non-resident as well as resident. 2ff.Miscellaneous: Parcel labelled 'Petitions to Parliament'. Copy of petition to the Commons from Freemen of the City of Chester, complaining that in the election between Richard Manley, Esq. and Robert Grosvenor, Esq. the magistracy illegally influenced the election, and alleging bribery and corruption.
