Plaintiff is lessee of William Jolly of property in Northgate Street, and claims that common of pasture of Hoole Heath is appurtenant to it. The defendants claim that the Heath is the freehold of the Earl of Shrewsbury. ii. Proofs taken on the part of the Mayor and Citizens of Chester, plts., v. Copy of depositions by John Traunter, gentleman, and Thomas Browne, gentleman Concerning the reasons for the delay in the execution of a Commission out of the Exchequer Court at Chester for ending the difference between the Earl of Shrewsbury and the City. The plaintiff's solicitor failed to get the rule drawn up at the last Great Sessions at Chester entered in the Prothonotary's office. Both sides agreed upon the appointment of referees for ending the difference, but at first the agents of the City would not fix a time for a meeting. Finally 19th Dec. last was appointed for the execution of the Commission, and Traunter and other agents of the Earl of Shrewsbury came down from London to attend.
