Feoffment de capitalibus dominis with Warranty contra omnes gentes in pursuance of articles of covenant in an Indenture 30 March 1551 between 1. Roger Domes and Robert Downes 2. William Davenport Kt, John Ardron Esq, John Warde of Capestorne Gent, and John Davenport Gent; with power of attorney to Richard Thirlwynde and Ralph Raynshaw clerks for entry and livery of seisin; in all Roger and Robert's messuages, lands, rents etc, and hereditaments in Poynton, Vpton [Upton], Taksall [Taxal], Stokport [Stockport], Torkington, Adlington and Bredbury co. Cestr' [Chester], to be held in trust to uses specified in the afsd Indenture. Endorsed; certificate of livery of seisin same day to John Dauenport late of Chadkyrke Gent for the other feoffees in presence of Humphrey Blacshaw, John Vnwyn, John Henshaw, Hugh Wood, and Henry Barlow.

Witnesses of sealing and delivery (endorsed): Sir Richard Thrilwynd, Sir Rauf Renshaw chaplains, Humphrey Blacshaw, John Blacshaw, and Richard Jepson.

Covenant to create by Indenture before Pentecost next following an estate in fee simple in lands (v. infra) to uses specified viz;-

1. Use of Roger Downes for life thereafter of Elyn Downes his wife for life as dower or of any other woman the wife of Roger Downes, thereafter of Lawrence Downes son of Roger Downes and his lawfully begotten heirs in default of which to use of Dorothy, Katherine, Sibill, Margaret, Elizabeth, Parnell, Elyn and Margery Roger's daughters and their lawfully begotten issue in default of which to use of right heirs of Lawrence Downes.

2. Use of Roger Downes for life, thereafter of such person as shall have married Lawrence Downes for life thereafter of Lawrence Downes and his lawfully begotten heirs in default of which to use of the afsd daughters of Roger Downes and their lawfully begotten heirs in default of which to use of right heirs of Lawrence.

3. Use of Roger Downes for life thereafter of Lawrence Downes and his lawfully begotten heirs in default of which to use of the afsd daughters of Roger Downes and their lawfully begotten heirs, in default of which to use of right heirs of Lawrence Downes.

In lands etc., the inheritance of Roger Downes and Robert Downes in Poynton, Vpton [Upton], Taksall (alias Taksal) [Taxal], Stokport [Stockport], Torkington (alias Torkynton), Adlington, and Bredburye (alias Bradbury), co. Chestr' disposed to uses as follows;- lands etc in Poynton and Adlington called the Hall of Worth with the orchards and gardens belonging, the Walkers felde, the Gorstie felde, the Rye croft, the Kylnecroft, the Little Heysberne, the Grett Heisberne, the High Ridding, the Shippon Hill Croftes, the Pale felde, the Lagher Worth, the Helde, the Pale Medow, the castell felde, the over horse gresse, the Laugher horse gresse, the comb'wheyn medow, the Crabtrie Flat, and the Mylne of Worthe, and messuages, lands etc in Poynton and Adlington held by John Leys, Lawrence Hall, Joan late the wife of Roger Wodd, George Wodd, Rauf Merchland, Robert Wodd, Raynold Gepson, Elizabeth late wife of Roger Wodd, Lawrence Wodd and Christopher Greves, to uses;

1. supra; and lands etc., in Vpton [Upton] called Whitfyld held by Hugh Holynshed and messuages etc., held by Joan late wife of Humphrey Shalcross, Raynold........ and Thomas Forth, John Woding, to uses;

2. supra; the residue of the lands etc the inheritance of Roger and Robert Downes are to be held to uses;

Physical DescriptionParchment: 2 membranes (1 + attachment), secured top left by parchment thong, the smaller (1 April) attached to the face of the larger (30 March); 10" wide by 9½" and 24" wide by 10". Seals: Pendant on both documents, two in each case, on labels, parcelled.
