Covenant to abserve and carry out the terms of a Decree in Chancery 27 November 1652 issued in settlement of a dispute concerning claims made by Sir John Fitzherbert Kt dcsd and thereafter by party 2 to this doct., against Sir Edward Leche Kt dcsd and thereafter against party 1 to this doct., upon an estate in the manors and lordshipps of Hathersedge (alias Haverishigge, Haverisheshigg', f. 6.) Over Padley and Nether Padley with appurtenances, in county Derby, and their lands tenements rehts etc in the townships villages hamlets and parishes of Hathersedge, Over Padley, Nether Padley, Grindleford, Coates, Thornell, Leam, Derwent (alias Darwent, f. 6.), Castleton, Bradwell and Indenture, county of Derby; which estate was created by Indenture of Bargain and Sale 2 November 1637 (13 Chas I) between 1. The Rt. Hon. Phillipp earl of Pembrok [Pembroke] and Mountgomary dcsd, Sir Benjamin Ruddierd and Sir Robert Pye Kts, 2 Sir Edward Leche, made for "a great and valuable consideration of money". Decree orders that all the estate is to be conveyed by Fine and Recovery to Leche in Fee Simple by the end of Hilary term next after 27 November 1652, he then to convey it to Sir John Evelyn, Richard Hatton and Ambrose Phillips in Trust before 1 March next thereafter, for securing a rent of £400 for 3 years payable in the Common Dining Hall of Grayes Inns county of Middlesex by William Fitzherbert of Norbury and William Lewen out of the rents and profits of the estate, terminable upon their payment of £11,000 to Leche within the 3 years whereupon the premises to be conveyed in fee simple to them by the sd. Trustees, or in default of such payment in fee simple to Leche. (The terms of the agreements herein follow the terms of the Decree; in one clause Leche covenants to keep harmless the Trustees especially in respect of the Dower of Jane his wife).
