Indenture to lead the uses of a Recovery to be suffered by Party 2 to Party 3 before 1 August next by Writ of Entry sur Disseisin in the Post (and accordingly suffered, as certified in an endorsement, in Trinity Term 12 Eliz as appears by Record Roll 72 and an exemplification thereof 20 February 1571 (13 Eliz)) in premises held by party 2 by virtue of Bargain and Sale of Party 1 viz;- all party 1's castles, manors, lordships, lands, tenements, rents, reversions, services, hundreds, wapentakes, liberties, franchises, and hereditaments in the counties of Derbye [Derby], Stafford, Sallopp' [Salop], Wilteshyre [Wiltshire], Oxford, Leister [Leicester] and Yorke [York] which he granted to party 2, viz;- in co. Derby the castle of Bolsouer, the manors of Southwyngfeild alias South Wynfeld', Crych, Sherland, Heigham, Stretton, Midleton, Eyam, Bamford, and Bolsouer and £10 rents issueing therefrom, and the advowson of the church of Eyam; in co. Stafford the manor of Alveton alias Awton and £5 in rents issueing therefrom and the advowson of the church of Alveton alias Awton; in co. Salopp' [Salop] the manors of Rockarden alias Wrockwarden; Cheswarden, Tasley, and Hulton and £6 rents issueing therefrom and the advowson of the churches of Rockarden alias Wrockwarden, Cheswarden and Tasley; in co. Oxford the manor and the hundred of Bampton and £10 rent in Bampton and the advowson of the church of Bampton; in co. Wilteshier [Wiltshire] alias Wilteshire the manors of Ashton Gyfford, Stokebardon alias Stokeburdon, or Stokebarden, and Willesford alias Wellesford, and the advowson of the churches of those places; in co. Leyster [Leicester] the manors of Cyttysby (alias Cyttisby, Byttysby, Bittisby -- the B- forms are all corrected to C- --) and Wylley alias Willey; in co. Yorke [York] the manors of Hansworthe Heyfeld alias Heighfeild, or Heighfeld', Heifeild, and Bolsterstone and rents in Overuden, Shephowse, Wyndell and Aldermanshead.

These premises are to be held to Uses by Party 3 as follows;- the castle and manor of Bolsouer to use of the earl for life then of the Rt. Hon the Lady Elizabeth now countess of Shrewsburye the earl's wife for her life with mining and timber rights, then of Gilbert Talbot Esq the earl's second son and Mary his wife for their lives or that of survivor, thereafter the right heirs of Gilbert; the manors of Stokeburdon and Wellesford co. Wilteshire [Wiltshire] to the use of the earl for life then of Lady Elizabeth for life then of Gilbert and Mary his wife for life of survivor, then of the heirs male of the body of Gilbert and in default thereof, to use of Edward Talbot Esq the earl's third son and his heirs male and in default thereof to use of Henry Talbot Esq the 4th son and his heirs male and in default to the use of the heirs male of the earl and in default thereof to use of the daughters of the earl and their several heirs male, and in default to use of Henry Cavendyshe Esq son of Lady Elizabeth; the manors of Cittysby and Willey co.Leister [Leicester] to use of the earl for life then of Lady Elizabeth for life then of right heirs of the earl; the rest of the premises to use of the earl for life then of Lady Elizabeth for life with rights of timber in a wood called Crych Chase in Crych and coalmining in the manors of Hansworth and Stretton, then to use of Francis now lord Talbott son and heir of the earl for life, then of Francis's son and his heirs male, and in default thereof to Francis's second, third and all subsequent sons in order, in default thereof to use of Gilbert Talbott Esq. for life then of his first and all subsequent sons in order and in default to use of Edward Talbot for life then of his sons, then to use of Henry Talbot Esq for life and then of his sons, and in default to use of the earl's daughters and their heirs male and in default to the heirs begotten of the earl and in default to use of Henry Cavendishe Esq. Proviso, that any one of the users who attempts to alter the terms of Settlement and break the entail will forfeit his interest in the estate and then party 3 will stand seised of the estate so forfeited to the use of the next entailed heir.
